Terms of Service

1. The service

Email Campaign is an internal tool for running email campaigns. It lets authorised users upload recipient lists, compose messages, connect sending mailboxes, and send campaigns through those mailboxes in paced batches.

It is not a public service. There is no open sign-up: accounts are created by Elena Digital for people it authorises, and can be withdrawn at any time.

2. Your account

• Keep your password confidential. You are responsible for activity under your account.
• Tell us at once at dk.elenadigital@gmail.com if you believe your account has been used without your permission.
• Do not share an account between people. Ask for a separate one instead.

3. Connecting mailboxes

When you connect a Gmail, Outlook or SMTP mailbox, you authorise Email Campaign to send email from it on your instruction. You confirm that you own that mailbox or have the authority of its owner to connect it.

You can withdraw that authorisation at any time — by removing the mailbox under Sender Accounts, or from the provider’s side through your Google Account permissions or your Microsoft account settings. How we handle the access you grant is described in the Privacy Policy.

Using a mailbox through Email Campaign does not release you from that provider’s own terms, including Google’s and Microsoft’s sending limits and acceptable-use policies.

4. Acceptable use

You are responsible for every campaign you send. You must not use Email Campaign to:

• send mail to people you have no lawful basis to contact, including lists bought, rented or scraped from elsewhere;
• send deceptive, misleading or impersonating messages, phishing, malware, or links to either;
• disguise who a message is from, or use a subject line that misrepresents its content;
• send unlawful, harassing, defamatory or infringing content;
• remove, hide or break the unsubscribe link, or re-add an address that has opted out;
• work around the sending limits, pacing or suppression list the service applies.

You must comply with the laws that apply to your campaigns and your recipients — which may include India’s Information Technology Act, 2000 and Digital Personal Data Protection Act, 2023, the US CAN-SPAM Act, and the EU and UK GDPR — including identifying the sender and including a valid postal address in commercial messages.

5. Your content and data

Recipient lists, message content, images and attachments you upload remain yours. You grant Elena Digital permission to store and process them only to operate the service for you.

You confirm you are entitled to upload the personal data in your recipient lists and to send them the messages you compose.

6. Delivery is not guaranteed

A message recorded as sent has been accepted by the mailbox provider. It has not necessarily reached the recipient’s inbox: providers can still filter, delay or reject it afterwards, for reasons outside our control. Sending limits, warm-up and pacing exist to protect your mailboxes and may make a campaign take several days.

7. Suspension

We may pause a campaign, disable a mailbox, or suspend an account without notice where we reasonably believe these terms are being broken, a provider has flagged a mailbox, or continuing would harm recipients, the service, or its mailboxes’ reputation.

8. Availability and changes

We aim to keep the service available but do not promise it will be uninterrupted or free of errors. We may change, suspend or discontinue features at any time.

9. Disclaimer

The service is provided “as is” and “as available”. To the extent the law allows, we make no warranties of any kind, express or implied, including of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of liability

To the extent the law allows, Elena Digital is not liable for indirect, incidental, special or consequential loss, or for loss of profits, data, goodwill or mailbox reputation, arising from use of the service — including a provider suspending a mailbox or filtering messages.

11. Indemnity

You agree to indemnify Elena Digital against claims arising from campaigns you send, the content or recipient data you upload, or your breach of these terms or of applicable law.

12. Changes to these terms

We may update these terms. The date at the top of this page shows when they last changed. Continuing to use the service after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of India, and its courts have exclusive jurisdiction over any dispute arising from them.
